Auction Description

Our February sale brings together a curated group of works from private collections, ranging from ancient pottery to modern and contemporary design. Highlights include two of James Turrell's very first holograms, a strong collection of ancient Mimbres pottery, museum-worthy African tribal art from a Private collection, and more than 90 lots of fine jewelry. The catalogue moves easily across periods and cultures, with an emphasis on objects chosen for their visual strength and quality. Many have been held privately for years and are rarely seen on the market.

COLLECTION OF THE WORK AND PASSING OF TITLE AND RISK OF LOSS

4.1 You are responsible for arranging for pick up of the work from our premises in New York City after payment in full of the purchase price has been made. Any such pick up must be scheduled during regular business hours and at a mutually agreed time and date.

4.2 From the time and date of agreed collection of the work from Newel, you will be responsible for the work and the risk of loss or damage shall pass to you.

4.3 Title to the work shall pass from Newel to you when the purchase price is paid in full. If Newel has agreed to allow you to have possession of the work before full payment of the purchase price has been made, you agree to: (a) keep possession of the work and insure it for not less than the purchase price, and not sell it or hand it over to any other person or dispose of any interest in the work; (b) allow Newel or a third party acting on Newel’s behalf to have access to the work in order to inspect it; and (c) preserve the work in the same state as it was on delivery and in particular, not restore, repair, clean or reframe the work.

IMPORTANT: Please read and understand these Terms and Conditions before participating in any transaction. If you do not agree with any term, discuss it with a Newel LLC (“Newel”) representative before proceeding. Participation in the auction constitutes full acceptance of these Terms and Conditions.

1. Purpose and Effect

These Terms and Conditions form the agreement—other than price—between you (“Buyer”) and Newel LLC (“Seller”) regarding the sale and purchase of the item(s) identified on the invoice (“Work”). Newel confirms it either owns the Work or is authorized to sell it on behalf of the owner. Any changes or additions must be agreed to in writing by Newel.

2. Statements About the Work

All items are sold AS IS. Any statements on authenticity, attribution, description, date, age, provenance, title, or condition reflect Newel’s opinion only and are not warranties. We are not liable for changes in expert opinion after the sale, except in cases of fraudulent misrepresentation.

Newel does not warrant or certify UL Laboratory compliance.

We will, upon request, explain the condition of the Work and provide reasonable information, but we are not responsible for any deterioration after sale.

Buyers are responsible for verifying any statements made by Newel.

3. Shipping & Pickup Information

Packing, handling, and shipping of purchased lots are the sole responsibility of the Buyer. Newel LLC does not provide packing or shipping services but recommends the following independent shippers. Newel receives no compensation for shipping referrals and strongly urges purchasers to obtain shipping insurance and more than one shipping quote.

Registration & Identification Requirement:

All Buyers must register prior to bidding and provide government-issued photo identification—either online or in person as part of the registration process.

A bank reference may be required to increase bidding limits,

Pickup Requirements:

Buyers (or their authorized agents) must present a valid government-issued photo ID at pickup.

For third-party pickups, Buyers must provide written authorization, along with a copy of the Buyer’s ID, to Newel in advance.

Property will not be released until Newel LLC has received payment in full and all funds have cleared. This applies to all payment methods, including credit cards, wire transfers, and any other approved form of payment.

Failure to follow these procedures may result in delays or refusal to release the property.

Buyer consents to Newel photographing or video recording the release and pickup of purchased property for security, verification, and record-keeping purposes.

4. Payment

All Sales Are Final.

Accepted forms: Visa, MasterCard, American Express, Discover, Wire Transfer.

Payment deadlines: Internet bidders — within 5 days; in-person bidders — within 1 hour.

All credit card payments are subject to a non-refundable 3% processing fee.

Credit Card Purchase Limit: Credit card payments are accepted up to a maximum of $5,000 per invoice. Any amount above this limit must be paid by wire transfer. Exceptions may be made at Newel LLC’s sole discretion for established clients in good standing.

Credit card transactions may require matching billing address, CVV code, and government-issued photo ID.

The cardholder name must match the registered bidder name.

Newel reserves the right to require wire transfer payment for any transaction.

Personal checks and PayPal are not accepted.

Buyer agrees that all sales are final and waives any right to initiate a credit card chargeback for any reason, including disputes over authenticity, condition, or description.

If Newel suspects fraudulent activity, it may cancel the transaction and relist the lot.

All funds must clear Newel LLC’s account before any property is released. For wire transfers, this may require up to three (3) business days after receipt. For credit cards, Newel reserves the right to hold property until the transaction is verified and settled.

5. Condition of Items

All lots are sold AS IS, WHERE IS. No oral or written statements about age, condition, value, or quality are warranties. No refunds are offered for condition-related issues. Buyers must inspect items or request condition reports before bidding.

6. Bidding

All bidders must pre-register and be approved by Newel.

Bidding options: in person, absentee bid, or online.

Newel is not responsible for failure to execute absentee bids or for electronic failures, including those caused by third-party platforms such as LiveAuctioneers.

Auctioneers may reject any bid and determine the winning bidder.

7. Buyer’s Premium

In-person bids: 18%

Internet bids: 23%

Applicable state and local taxes will be charged unless a valid exemption certificate is provided.

8. Removal of Property

In-person purchases: remove by 5:00 PM on the Monday after the sale.

Internet purchases: pick up within 10 days.

Storage fees: $25 per lot/day after the deadline. After 30 days, Newel may re-auction the property, retaining proceeds as storage fees.

Title transfers at auction close; Buyer assumes all risk for damage, loss, or theft thereafter.

9. Indemnification

Buyer agrees to indemnify and hold Newel harmless from claims, damages, or liabilities related to third-party auction platforms, including LiveAuctioneers.

10. Buyer Responsibility for Legal Transport & CITES Compliance
Buyer is solely responsible for ensuring purchases comply with all local, state, federal, and international transport laws, including those covering ivory, tortoiseshell, and other protected materials. Buyer must obtain all required documentation (e.g., CITES permits). Newel will not obtain permits or be liable for delays due to missing documentation.

11. Auctioneer’s Discretion

Auctioneer reserves the right to reject bids, determine increments, and resolve disputes at their sole discretion. All auction sales are final.

12. Copyright

All auction catalog images and text are the property of Newel LLC. No reproduction or use is permitted without written consent. Copyrights remain with Newel.

13. Non-Payment & Default

If the Buyer fails to make payment in full within the stated timeframe, Newel LLC reserves the right to cancel the sale, retain any deposit, and resell the property. The Buyer will be liable for any deficiency, collection costs, attorney’s fees, and other damages incurred as a result of default.

14. Dispute Resolution & Recovery of Legal Costs

In any action to enforce these Terms and Conditions or recover payment, the prevailing party shall be entitled to recover its reasonable attorney’s fees, court costs, and any other expenses incurred from the non-prevailing party.

15. Online Bidding Disclaimer

Newel LLC is not responsible for errors, delays, or failures in transmission, internet connectivity, or platform operation that may prevent bids from being placed or acknowledged. The Auctioneer’s record of the sale shall be final and conclusive.

16. Acceptance of Terms

By registering to bid, placing a bid, or completing a purchase, the Buyer acknowledges they have read, understood, and agreed to be bound by these Terms and Conditions.

17. Taxes & Required Documentation

All purchases are subject to applicable state and local sales taxes unless the Buyer provides a valid resale certificate or proof of tax exemption acceptable to Newel LLC before payment is made.

Out-of-state shipments may be exempt from sales tax if the Buyer provides a Bill of Lading from a licensed common carrier showing delivery outside the state of New York.

Buyers claiming a resale or exemption status must provide Newel LLC with a fully completed resale certificate and any other documents required under applicable law.

If the Buyer fails to provide the necessary documentation prior to payment, sales tax will be charged and will not be refunded.

Newel LLC reserves the right to verify the validity of all resale and exemption certificates.
